FWCJUA Market Assistance Program

The purpose of the Market Assistance Program (MAP) is to provide access to and assist in the placement of workers’ compensation and employer’s liability insurance coverage in the voluntary market for employer’s applying for or securing coverage through the FWCJUA. MAP also assists employers who submit applications for coverage by the FWCJUA in obtaining coverage in the voluntary market. The FWCJUA provides three reports to insurers and/or to Agencies and their Designated Producers authorized to submit applications to the FWCJUA. The first report provides account profiles for applications received daily by the FWCJUA. The second report provides Account – Profiles for all employers for which the FWCJUA bound coverage in the prior month.  The third report provides Account – Profiles for all employers currently written by the FWCJUA with expiration dates three months from the current month.

Account Profiles include the following key application data:

  • Employer name and FEIN, if applicable
  • Effective date reserved for in-process applicants or effective date of the FWCJUA policy in-force
  • Governing class code of the employer and a description of the business
  • Total number of employees estimated to be covered under the policy
  • Total estimated annual payroll for all those employees, including corporate officers, sole proprietors, and partners.
  • Total estimated annual premium for the employer
  • Experience modification factor for the employer, if applicable
  • Risk ID number, if applicable
  • Prior carrier, if applicable
  • Street address, city, state, zip code and phone number of the employer
  • Street address, city, state, zip code and phone number of the producer of record
  • Tier Assignment

As provided in section 627.311(5)(c)24., Florida Statutes, an Employer insured through the FWCJUA who is offered coverage from an Insurer:

(a) During the first 30 days of FWCJUA coverage;

(b) Before an FWCJUA policy is issued;

(c) By issuance of a policy upon expiration or cancellation of the FWCJUA policy; or

(d) By assumption of the FWCJUA's obligation with respect to an in-force policy,

is no longer eligible for coverage through the FWCJUA. The premium for risks assumed by the Insurer must be no greater than the premium the Insured would have paid under the FWCJUA, and shall be adjusted upon renewal to reflect changes in the FWCJUA rates and the tier for which the Insured would qualify as of the time of renewal. The Insured may be charged such premiums only for the first 3 years of coverage by the Insurer. A premium under section 627.311(5)(c)24, Florida Statutes, is deemed approved and is not an excess premium for purposes of section 627.171, Florida Statutes.

MAP Partnership Program
CompLinx
The FWCJUA has partnered with CompLinx in a program to provide greater access to and assist in the placement of coverage in the voluntary market for employers applying for or securing coverage through the FWCJUA. CompLinx provides direct access to additional markets directly or through wholesalers providing increased class code and loss ratios. These carriers have expanded their underwriting guidelines to accept a wide range of classes and loss history due to the FWCJUA surcharged premiums. CompLinx does not sell insurance but assists in the negotiations with carriers/wholesalers in regards to the commission paid to the agents. Typically, the “co-broker” commission will be more than the commission paid on an individual account bound through the FWCJUA making this a win-win situation for all. Authorized agencies and their designated producers may register directly with CompLinx at http://www.complinx.com/ and for a monthly fee submitted directly to CompLinx, will be able to co-broker business with CompLinx to markets the authorized producer may not usually have access to. Otherwise, the authorized producer may continue to submit business “as ususal”, at which point the FWCJUA shall run the authorized producer’s application submissions through the CompLinx system.
