Agency Authorization 

Each Agency must meet the minimum standards identified below in order to submit Applications for Coverage to the FWCJUA.  Please note that an Agency and any of its Designated Producers who receives authorization to submit Applications for Coverage to the FWCJUA has no authority, actual or apparent, to bind coverage on behalf of the FWCJUA or automatically assume the responsibility of issuing Certificates of Insurance without prior consent and written permission from the FWCJUA or its Service Provider.

Minimum Agency Authorization Standards: 

  1. The Agency must maintain errors and omissions insurance or professional liability insurance issued by an Insurer authorized to do business in Florida covering the Agency, all Designated Producers, and Customer Service Representatives (CSRs) in an amount not less than $500,000 per occurrence. 
  2. Each location of the Agency must be duly licensed and/or registered with the Florida Department of Financial Services, Division of Agent and Agency Services.
  3. Each Designated Producer must be individually licensed by the Florida Department of Financial Services as a general lines resident (2-20) or non-resident (9-20) insurance agent authorized to solicit, negotiate and effectuate workers compensation insurance.
  4. Each CSR must be individually licensed by the Florida Department of Financial Services as a resident (4-40) or non-resident (9-40) Customer Representative.
  5. Each Designated Producer or the Agency must serve as an insurance agent or insurance agency, as the case may be, of an Insurer actively writing workers compensation and employers liability insurance in the state of Florida, pursuant to a certificate of authority issued by the Florida Office of Insurance Regulation.
  6. The Agency and each of its Designated Producers must execute an Agency Producer Agreement with the FWCJUA, and remit a one time fee of $100 per Designated Producer to the FWCJUA.

Agency Authorization Request Submission:

If the Agency meets the above requirements, and wishes to continue with the authorization process, the Agency will need to:

  1. Print and complete the Agency Producer Agreement, including Exhibits A and B, and secure the signatures of the Agency Principal and each Designated Producer. A separate Exhibit A must be completed for each Agency location under the Agreement. All locations under the same Agency FEIN must be disclosed even if the Agency will not submit business through that particular location.   2. Secure a Certificate of Insurance for either the Agency's E & O or Professional Liability insurance identifying the FWCJUA as the certificate holder, and providing the contact name and phone number of the Insurer.
  3. Email the executed Agency Producer Agreement, including Exhibits A & B, and the Certificate of Insurance discussed above to agency@fwcjua.com.

Do not send a check for the Designated Producer fees until the FWCJUA notifies the Agency via email that it is eligible for authorization.  At that time, the Agency will be provided instructions on remitting the fees for the Agency's Designated Producer(s).

Eligibility Review Process:

  1. Upon receiving the Agency authorization submission, the FWCJUA will review the submission within 24 hours of receipt to determine eligibility for authorization.
  2. If deemed eligible, the Agency and its Designated Producers will be authorized to submit business to the FWCJUA. The Agency will then be emailed a Welcome Letter notifying the Agency of its Authorzation along with a copy of the fully executed Agreement and instructions on remitting the Designated Producer fees to the FWCJUA. Upon receipt of the fees, the FWCJUA will then provide each Designated Producer with a username and password for accessing the Online Application for Coverage and will add the Agency and its Designated Producers to the Agency/Producer Locator on the FWCJUA's website.

  3. If the FWCJUA is unable to determine eligibilty, a request for additional information will be sent via email to the Agency. If the Agency does not timely repond to the information request or is deemed ineligble for authorization, the FWCJUA shall notify the Agency that its authorization request was closed or denied with the reasons for such being noted.

Changes Required to Exhbit A following Authorization:

After authorization, an Agency desiring to add or delete a Designated Producer or Customer Service Representative during the term of the Agency Producer Agreemenet should complete and submit an Agency Producer Agreement Addendum A to the FWCJUA via email to agency@fwcjua.com.
